ICC’s Appeals Chamber unanimously reverses Pre-Trial Chamber’s decision to exclude counts of genocide in Al-Bashir’s arrest warrant

In its judgment of Wednesday 3rd February 2010, the Appeals Chamber of the International Criminal Court (ICC) unanimously reversed the 4th of March 2009 decision of Pre-Trial Chamber I. The Appeals Chamber concluded that the standard of proof required by the Pre-Trial Chamber in its decision was higher and more demanding than what Article 58 of the Rome Statute calls for. It ruled that this therefore amounted to an error of law and asked the Pre-Trial Chamber to decide anew on whether the arrest warrant against president Al-Bashir should cover the charge of genocide.
